The situation
A planned sale or letting of buildings or units
A developer is selling 48 new flats in Vienna and letting 30 refurbished flats in Valencia. The agency has the adverts ready to go live. Before they do, the developer wants to know what the energy certificate rules require of the adverts, the viewings and the contracts in each city.
Everyone knows a certificate is needed. The hours go on the detail: which figures an advert must show, when the certificate must be presented and handed over, who issues and registers it, and what follows if a contract is signed without one.
What the research has to settle
The rules behind the answer
- The EU directive sets the frame
- The Energy Performance of Buildings Directive requires a certificate when a building or unit is sold or let to a new tenant. It must be shown to prospective buyers or tenants and handed over, and adverts must state the energy performance indicator.
- Austria: present before, hand over after
- Austrian law requires the seller or landlord to present the certificate before the buyer or tenant signs, and to hand it over within a short period after the contract. Adverts in print and online must state the key indicators from the certificate.
- Spain: issued, registered and labelled
- Spanish rules require the certificate to be issued by a qualified technician and registered with the regional authority. The energy label must appear in offers and advertising for sale or rent.
- The recast directive is being transposed
- The EU recast the directive in 2024, with changes to the certificate’s format and scale. The research confirms what each country has transposed and from when.

Energy certificates: Vienna sales and Valencia lettings
Adverts. Every advert in Vienna, print or online, shows the heating demand and the overall energy efficiency factor from the certificate. Every advert in Valencia shows the energy label. The agency does not publish any advert until it has these figures.
Viewings and contracts. In Vienna, buyers see the certificate before they sign and receive it within the statutory period after signing. In Valencia, prospective tenants can see the registered certificate, and a copy goes to each tenant with the lease.
Owners. Adverts: sales director. Certificates and registration: technical director. Handover records: the sales office, which keeps a signed receipt for each unit.

Frequently asked questions
- Does azta issue or check the certificate?
- No. Only a qualified assessor can issue it. azta researches what the law requires you to do with it.
- Does it cover Spain’s regional rules?
- It searches national legislation in the BOE collection. Regional registers and procedures may add requirements, so check the region’s own rules where the answer depends on them.
- Are some buildings exempt?
- The directive allows exemptions for some building types. Ask with the facts and azta researches whether an exemption applies in that country.
