The situation
An installation entering the EU emissions trading system
A paper mill in Saxony is replacing its boilers with a larger gas-fired unit, which takes the site’s total rated thermal input above the threshold for the EU emissions trading system. The site director wants to know what changes: permits, plans, reports and the yearly cycle of allowances.
The rules sit in three layers: the EU directive and regulations, German law and the authority’s guidance. The hours go on putting the obligations in order, from the permit and monitoring plan to the verified report and the surrender, with a date and an owner for each.
What the research has to settle
The rules behind the answer
- A permit and an approved monitoring plan
- An installation carrying out an activity listed in the ETS Directive needs a greenhouse gas emissions permit, and its monitoring plan must be approved by the competent authority. In Germany, the German Emissions Trading Authority approves the plan.
- Monitoring follows the EU regulation
- The Monitoring and Reporting Regulation sets how emissions are monitored, the tiers of accuracy and the rules for changing the plan. Significant changes to the monitoring plan need the authority’s approval.
- A verified report every year
- Each year’s emissions report must be verified by an accredited verifier under the Accreditation and Verification Regulation and submitted by 31 March of the following year.
- Surrender, then compliance
- The operator surrenders allowances equal to its verified emissions. Since the 2023 revision of the directive, the deadline is 30 September, and failing to surrender triggers a fixed excess-emissions penalty per tonne.

The question, as you would type it
Paper mill in Saxony installing a new gas-fired boiler that takes total rated thermal input above the ETS threshold. What do we need before start-up, and what are the annual monitoring, reporting, verification and surrender duties and deadlines under the ETS Directive and German law?

Entering the EU ETS: duties and annual calendar for the mill
Before start-up. Apply for the emissions permit and submit the monitoring plan for approval, with the evidence on meters and calculation methods. Check whether the mill can apply for free allocation as a new entrant and, if so, by when. Owner: EHS lead with the energy manager.
Every year. Monitor emissions under the approved plan. Have the report verified and submit it by 31 March. Surrender allowances for the previous year’s emissions by 30 September. Owner: energy manager, with finance holding the registry account.
Changes. Any change to the boilers, fuels or meters is checked against the monitoring plan before it happens, and significant changes are submitted for approval first.

Frequently asked questions
- Does azta hold the German authority’s ETS guidance?
- No. It holds the ETS Directive, the EU monitoring and verification regulations and the German legislation, not the authority’s guidance and templates. Check those alongside the cited law.
- Does it cover the new emissions trading for buildings and transport?
- Yes, as legislation. Ask about it separately: it applies to fuel suppliers rather than to installations like the mill.
- Can it write the monitoring plan?
- No. It sets out what the regulation requires the plan to contain. The plan itself is prepared by your team on the authority’s templates.
