Investment incentives are granted, not claimed. Poland’s support decisions for new investment and the Czech investment incentives scheme both depend on an application made before the investment starts. Starting work, or placing binding orders, too early can rule the project out.
State aid rules cap the total. Tax relief tied to an investment is state aid. The EU General Block Exemption Regulation sets maximum aid intensities by region and company size, and all aid for the same costs counts toward the cap.
Conditions run for years. Support depends on making and keeping the investment and the jobs for a set period. Breaching the conditions can mean repaying the relief with interest.
Ordinary tax rules still apply. Outside the incentive schemes, the depreciation rules and any reliefs in the income tax acts apply as usual. The note should cover both before the board assumes a figure.

Tax incentives for the three-year investment plan

Wrocław plant. The new plant may qualify for a support decision under the Polish Investment Zone, which gives an income tax exemption up to a capped amount. The application must be made before the investment starts, and the relief depends on the decision that follows. The conditions on spending and jobs are in Annex 1.

Pilsen site. On its own, the solar and heat-pump investment is unlikely to meet the criteria of the Czech investment-incentive scheme; we are confirming this with the Czech advisors. Ordinary tax depreciation applies, as set out in Annex 2.

Caps and timing. Any relief granted counts toward the regional state aid cap for the project. No binding orders for the Wrocław plant should be placed before the application is filed, and the business case should not assume the relief until the decision is issued.

The situation

A multi-year investment plan with locations and amounts

A German-owned car-parts maker plans to invest EUR 40 million over three years: a new plant near Wrocław, and rooftop solar and heat pumps at its existing site in Pilsen. The board wants to know whether tax incentives improve the business case, and what strings come with them.

Incentives are rarely automatic. The hours go on finding which schemes the investment could fit, the application and timing rules, how the aid is capped, and what happens if the jobs or the spending fall short. The note has to show the conditions as clearly as the benefit.

What the research has to settle

Frequently asked questions

Does azta cover grants as well as tax incentives?
It researches the legislation behind support schemes. Grant calls and agency guidelines are often published outside legislation, so check those with the agency.
Can it say how much relief we would get?
No. It sets out the schemes, conditions and caps with the provisions behind them. The amount depends on your figures and the agency’s decision.
Can it compare incentives in more countries?
Yes. Name the countries and ask for a comparison table. Each row cites the national provision.
