The situation
A planned generation or storage project and its location
A developer has land for a 60 MW battery storage project near Poznań and a 25 MW solar park in Groningen. The investors want to know how and when each can connect to the grid, what the operator can refuse, and what happens if the network is congested.
The engineers run the technical studies. Counsel handles the law: what the application must contain, what the operator must decide and by when, what the connection fee covers, what the EU network codes require of the plant, and what the developer can do if the answer is no.
What the research has to settle
The rules behind the answer
- EU network codes set the technical baseline
- EU regulations set the requirements for connecting generators and demand facilities to the grid. National operators apply them through their own connection rules, which the project has to meet.
- Poland: connection conditions first
- Under Polish energy law, a developer applies to the network operator for connection conditions, which the operator issues or refuses. A refusal on technical or economic grounds must be justified, and disputes can go to the energy regulator.
- An advance payment secures the application
- Polish law requires an advance payment toward the connection fee with the application for generation projects. The amount and the refund rules are set by statute and are what the research confirms for storage.
- Congestion and priority in the Netherlands
- Where the Dutch grid is congested, operators may place connection requests on a waiting list. Prioritisation and flexible connection contracts are governed largely by the regulator’s codes, which sit alongside the national energy legislation.
How it runs in azta
From the question to the document
The question, as you would type it
Developer plans a 60 MW battery storage project near Poznań and a 25 MW solar park in Groningen. What are the statutory steps to obtain a grid connection in each country, what can the operator refuse, and what can we do if the grid is congested or the conditions are refused?

Grid connection: Poznań storage and Groningen solar
Poznań. We apply to the distribution operator for connection conditions, with the documents in Annex 1 and the statutory advance payment. The operator must issue the conditions or refuse within the statutory period. A refusal must be justified, and a dispute over it can be referred to the energy regulator.
Groningen. The regional operator has reported congestion in the area. Our request joins the waiting list in order of receipt unless the project qualifies for priority under the regulator’s framework. A flexible connection with limited capacity at peak hours is an alternative we should ask about.
Timeline. Investors should assume the connection date, not the build time, sets the project timeline in both countries. We will update this note when the operators respond.

Frequently asked questions
- Does azta hold the network codes?
- It holds EU law, including the EU network code regulations, and national legislation. National regulators’ codes and operators’ own conditions are often published elsewhere, so check those at source.
- Does it find court decisions on refused connections?
- Where the national courts publish them, yes. Ask for decisions on refusals or connection fees and azta links each one.
- Can I ask about the law before a recent reform?
- Yes. Give the date and azta focuses on the law as it stood then, which matters for applications filed before a change.
