Working time or rest, nothing in between. Under the Working Time Directive, any period is either working time or rest. Standby at the workplace is working time. Standby elsewhere depends on the constraints placed on the worker.
The Court of Justice’s test for standby. Standby is working time where the constraints objectively and very significantly affect the worker’s ability to manage free time and pursue their own interests. Matzak (C-518/15) and the 2021 judgments on standby set out how response times and other constraints are weighed.
Rest must still be given. The directive requires eleven consecutive hours of daily rest in every 24 hours, subject to permitted derogations. A night call-out interrupts rest, and national law sets how the rest is made up.
National law sets the limits. German law distinguishes on-call duty at home from standby at the workplace and allows some deviations by collective agreement. Dutch law has specific rules for on-call duty, including limits on how often it can be scheduled.

On-call time for field technicians: Enschede and Münster

The test. On-call time at home counts as working time only if the constraints on the technicians objectively and very significantly limit how they can use their free time. Time actually spent on a call-out, including travel to the fault, is working time.

Our rota. A ten-minute answer time is short, but forty-five minutes to reach a fault and a company van leave the technicians some freedom. On the decisions reviewed, the on-call periods are more likely to count as rest, with call-outs counted as working time. The works council may argue otherwise, and Annex A shows decisions going both ways.

Rest. After a night call-out, the rota must still give the daily rest required in each country. The Dutch and German rules on making up rest differ and are set out in Annex B, with the provisions.

The situation

The on-call rota of field technicians

A network services company employs 180 field technicians in the Dutch and German border region, based in Enschede and Münster. They are on call one week in four, must answer within ten minutes and reach a fault within forty-five. The works council has asked whether the on-call hours count as working time.

The EU rules and the Court of Justice set the test. National law adds the limits and the rest rules. The hours go on applying the test to these response times, checking rest after night call-outs, and writing the answer clearly enough for the rota planners in each country.

Frequently asked questions

Does azta cover our collective agreement?
Upload it and azta reads it alongside the law, referring back to the clause it relied on. It does not hold collective agreements otherwise.
Does the working-time test decide on-call pay?
No. Pay for on-call time is set by contract and collective agreement, not by the working-time rules. Payroll stays with you.
Can I ask about other countries where we have crews?
Yes. The directive applies across the EU, and azta researches each country’s working-time act and courts on the same question.
