In the Netherlands it is a municipal tax. Dutch law allows municipalities to levy tourist tax on overnight stays by people not registered as residents of that municipality. Each municipality sets the base and the rate in its own by-law, so Rotterdam and Utrecht can differ.
The Dutch provider is assessed. The tax can be levied on whoever provides the accommodation, who may pass it on to the guest. Where the by-law levies it on the provider, the hotel is answerable for the amount whether or not it shows it on the bill.
In Spain it is regional, where it exists. Spain has no national tourist tax. Catalonia and the Balearic Islands levy their own, with the accommodation provider collecting from the guest as substitute taxpayer. Other regions differ, so each address is checked separately.
Exemptions and side questions. Both regimes exempt some stays, often by the guest’s age or the purpose of the stay, and the evidence for each exemption must be kept. Whether the tax forms part of the VAT base is a separate question with its own answer per country.

Tourist tax: what reception does at each property

Rotterdam and Utrecht. The tax is levied by the municipality under its own by-law. The hotel is assessed and may pass the tax on to the guest. Check the current by-law each January, because the base and rate are set locally. Guests registered as residents of the same municipality are not taxed.

Barcelona and Palma. The tax is regional. Reception collects it from the guest as substitute taxpayer and shows it on the bill. Record each exempt stay with the reason and the document that supports it.

For all properties. Keep the guest register, the nights per guest and the exemption evidence for the full retention period. Finance files the returns on the schedule set by each authority.

A replay of this page’s example. In azta every line of the answer carries a citation that opens the provision itself.

The situation

An accommodation business with properties in two countries

A boutique hotel group with properties in Rotterdam, Utrecht and Barcelona is adding a fourth in Palma next spring. Each front office handles tourist tax its own way. The Barcelona team itemises it on the bill, the Dutch teams fold it into the room rate, and nobody has written down why.

The group controller wants one guide for all four houses before the Palma opening. The hours go on finding which law sets the tax at each address, who the taxable person is, which guests are exempt and what evidence the front office must keep.
