The situation
A client’s plan to send staff to work in France
A Wrocław company that installs industrial refrigeration has won a contract at a food plant near Lyon. It will send eight technicians for about five months from March, with a site manager rotating in and out. The managing director asks the firm what must be in place in France before the first van leaves.
The Directive gives the frame and France fills in the detail. Each technician needs the right pay under French rules, the declaration must be made, a representative named and social security settled with A1 certificates. The hours go on pinning down each French requirement and turning it into a checklist the client can run.
What the research has to settle
The rules behind the answer
- Host-country terms apply from day one
- Under the Posting of Workers Directive, as amended in 2018, posted workers are entitled to the host country’s core terms, including remuneration as set by its law and generally applicable collective agreements, not only the minimum wage.
- Long postings bring in more
- After 12 months, or 18 after a motivated notification, almost all of the host country’s employment law applies. Replacing one worker with another on the same task does not restart the clock.
- France requires a prior declaration
- Before the work starts, the employer must declare the posting online to the French labour inspectorate and appoint a representative in France. French law also puts verification duties on the French customer. The research confirms the documents to keep on site.
- Social security can stay in Poland
- Under Regulation 883/2004, a posted worker can remain under Polish social security for an anticipated posting of up to 24 months, if the conditions are met. The A1 certificate issued by ZUS is the proof.

Posting technicians to the Lyon site: what to put in place
Pay. For the time in France, each technician must receive at least the remuneration French law and the applicable collective agreement require for the work, including allowances that form part of pay. Compare each technician’s package with that standard before departure.
Before work starts. Declare the posting online for each technician and name a representative in France who can deal with the labour inspectorate. Keep the employment contracts, pay slips and A1 certificates available in French for inspection. Give the French customer a copy of the declaration.
Social security. Apply to ZUS for an A1 certificate for each technician. Contributions continue in Poland for the duration of the posting.
