The situation
The return and refund flows of shops in Poland and Slovakia
A Polish shoe retailer runs stores and a webshop in Poland and, through a Slovak subsidiary, two stores and a webshop serving Bratislava and Košice. Online return rates run close to a third. Some refunds are paid in cash at the till, some by card, some as store credit, and wholesale customers get credit notes.
The auditors found that VAT was reduced in different periods in the two countries, and some refunds were never matched to a correction at all. Accounts needs one procedure per country: which document, which period, what evidence, and how a till return differs from an invoice correction.
What the research has to settle
The rules behind the answer
- The taxable amount can be reduced
- The VAT Directive requires member states to reduce the taxable amount when a sale is cancelled or the price is reduced after the supply, under conditions they set. The conditions are national, and they differ.
- A correcting document counts as an invoice
- Under EU rules, a document that amends the original invoice and refers to it specifically is treated as an invoice. National law sets what else it must contain and how it is issued, including through national e-invoicing systems where they apply.
- Timing and evidence are national
- Polish law ties the reduction to the period of the correcting invoice and to documentation that the agreed conditions of the correction were met. Slovak law sets its own conditions. Getting the period wrong distorts the returns in both countries.
- Till returns are a separate flow
- Refunds of sales recorded on a cash register follow their own record-keeping rules, separate from invoice corrections. A refund as store credit raises its own question, because it may fall under the voucher rules.

The question, as you would type it
Polish retailer with a Slovak subsidiary. Customers return online purchases and we refund by card; store customers get cash refunds at the till. In each country, when may we reduce output VAT, what must the correcting document show, and how are returns of till sales recorded?

Returns and VAT corrections: Poland
Invoice sales. For a return of goods sold on an invoice, issue a correcting invoice that refers to the original and shows the corrected amounts. Reduce output VAT in the period the correcting invoice is issued, provided the file holds evidence that the return was agreed and completed.
Till sales. Returns of goods sold through the cash register are entered in the separate returns record kept for till sales, with the original receipt. The annex sets out what the record must contain.
Store credit. Where we refund by store credit instead of money, the treatment is still open. The annex sets out the two possible readings for decision before the next period closes.
