Poland limits Sunday trading by statute. Polish law bans trade, and employing staff in trade, on most Sundays and public holidays, with a short list of trading Sundays and exceptions for certain types of outlet. The list of trading Sundays is set by law and has changed, so the research confirms the current one.
Polish staff keep Sundays off regularly. Under the Polish Labour Code, an employee who works on a Sunday is entitled to another day off, and must have at least one Sunday off every four weeks. Work on a public holiday also earns a day off.
Austria regulates opening and rest separately. Austrian law sets shop opening hours, with Sundays and public holidays closed in principle and exceptions for certain stations and tourist areas. A separate law governs weekend and holiday rest for employees.
Holiday work is paid on top. In Austria, an employee who works on a public holiday keeps the holiday pay and is paid for the work as well. The retail collective agreement adds its own rules on surcharges.

December rota: Sunday and holiday work

Poland. Stores may open only on the trading Sundays listed in the annex. On other Sundays and on public holidays, staff may not be rostered for sales work. Anyone working a trading Sunday gets another day off, and every employee must have at least one Sunday off in every four weeks.

Austria, high-street stores. Stores stay closed on Sundays and public holidays. Remove the two holiday openings from the draft rotas.

Austria, station store. The station store may open under the exception for railway stations, within its conditions. Employees who work a public holiday receive their holiday pay plus pay for the hours worked, and the collective agreement surcharges apply on top.

The situation

The December rota for stores in Poland and Austria

A Czech fashion retailer runs 40 stores in Poland and 12 in Austria, including one at a Vienna railway station. December is the busiest month. Store managers have drafted rotas with extra Sunday shifts and want to open on two public holidays. HR has a week to check the rotas before they go to staff.

The rules come from two places in each country: when a store may open at all, and what the law requires for employees who work on a Sunday or holiday. The station store may fall under an exception. The time goes on matching each draft shift to a rule and telling managers what to change.
