The situation
A small client’s plan to hire its first employees
Your accounting firm in Cieszyn serves clients on both sides of the border. This month two of them hire for the first time: an online plant shop in Cieszyn taking on two warehouse packers, and a café across the river in Český Těšín hiring its first barista. Both ask you what they need to do beyond payroll.
Safety is outside payroll, but clients ask their accountant first. The time goes on finding the employer’s duties in each country’s labour and safety law, separating what must happen before the first working day from what follows, and writing it so a shop owner can tick it off.
What the research has to settle
The rules behind the answer
- The EU framework sets the base
- EU law requires every employer to assess the risks to workers’ safety and health, inform and train them, and arrange protective and preventive services. National law sets how, and in what form.
- Medical examination and training come first
- In both countries a new employee needs an entry medical examination by an occupational physician, and initial safety training at the start of work. The Polish rules require both before the employee is allowed to start.
- A documented risk assessment
- Both countries require the employer to assess the risks of each job and keep a record. For a packer that covers lifting and handling; for a barista, burns, slips and cleaning chemicals.
- Owners can take on safety tasks, within limits
- Small employers can carry out the safety-service tasks themselves, or appoint an employee or an outside specialist. National law sets the size and risk limits for doing it personally and the training the owner needs.

Cieszyn plant shop: safety duties before and after day one
Before the first working day. Send each new employee for the entry medical examination with an occupational physician, on a referral from you. Arrange initial safety training, made up of general instruction and instruction at the workstation. Keep signed records of both in the employee’s file.
Risk assessment. Assess and record the risks of the packer’s job, including lifting, repetitive handling and the pallet truck, and tell the employees the result. Review it when the work or the equipment changes.
Safety service. With two employees, you may be able to carry out the safety-service tasks yourself after completing the required training, or you can appoint an outside specialist. Section 4 compares the two, with the provisions behind each.

Frequently asked questions
- Does azta hold the safety authorities’ guidance?
- For most countries it holds the legislation and EU law, not every safety authority’s guidance. It says what it cites, so you can see when guidance still needs checking.
- Is this outside an accountant’s remit?
- The list sets out the statutory duties with their sources. Whether you advise on them or refer the client to a safety specialist is your call.
- Can I send the list in the client’s language?
- Yes. Select the text in Canvas and ask azta to translate it, then export it to Word.
