The situation
A restaurant group’s tips practice and a proposed service charge
A restaurant group runs six restaurants in Amsterdam and Rotterdam and three in Vienna. Most tips now arrive on the card terminal. The managers pool them, and payroll pays them out monthly. The Vienna managers also want to add a service charge to bills for groups of eight or more.
The finance team has been asked for a written tips policy. The hours go on the treatment of each flow: cash tips kept by staff, card tips paid through payroll and a compulsory service charge, for payroll tax, social insurance and VAT, in both countries.
What the research has to settle
The rules behind the answer
- A tip is not a service charge
- A voluntary tip is not consideration for the meal and is outside VAT. A charge the guest must pay is part of the price and is taxed with it, whatever it is called on the bill.
- Dutch tips count as wages
- In the Netherlands tips are wages for payroll tax purposes. When the employer collects card tips and pays them out, they run through payroll. Tips that pass directly from guest to employee raise a separate question the research has to answer.
- Austria exempts customary tips, with conditions
- Austrian income tax law exempts customary tips given voluntarily by a third party to an employee, subject to conditions. Social insurance treats tips separately, and those rules have been under reform, so the research confirms what applies on the payroll date.
- The employer’s role changes the answer
- Who collects, who decides the split and how the money is paid can move a tip from one treatment to another. The policy should describe the practice as it really works.

Tips and service charges: how we handle them
Tips are voluntary. A tip is what a guest chooses to give on top of the bill. We do not add tips to the bill, and staff never ask for a set amount. Card tips are recorded separately from sales in the till.
Card tips. In the Netherlands, card tips are pooled and paid through payroll each month with the usual wage tax. In Vienna, card tips are passed to staff in full. Payroll applies the treatment confirmed for the payment date, which finance reviews each January.
Service charge, Vienna. A charge added to every bill for groups of eight or more is part of the price, not a tip. It is shown on the bill, included in sales and taxed with the meal.
