Dutch collection costs follow a statutory scale. In the Netherlands, extrajudicial collection costs charged to a consumer are capped by a statutory scale, and may only be charged after a reminder that gives the consumer fourteen days to pay without costs. A fee above the scale, or charged without that reminder, cannot be claimed.
Interest has limits. Polish law caps contractual and default interest by reference to a statutory maximum. In Dutch consumer cases, statutory interest applies unless a valid contractual rate does. The letters should state the rate claimed and its basis.
Pressure can be an unfair practice. Under the Unfair Commercial Practices Directive, persistent unwanted contact and threats of action that cannot legally be taken are aggressive practices. A letter warning of steps the company is not entitled to take falls into that category.
Unfair terms reach collection too. Courts must examine consumer contract terms for unfairness of their own motion, including cost and penalty clauses, under the Unfair Terms Directive. A claim built on an unfair term can fail even if the consumer does not object.

Consumer collection letters: Netherlands, templates 1 to 5

Template 1, first reminder. The €35 fee cannot be charged at this stage. Collection costs may only be claimed after a reminder that gives the consumer fourteen days to pay without costs, and then only within the statutory scale. We have redrafted the letter as that reminder.

Template 3, final notice. The warning that the consumer’s salary will be attached next week describes a step that needs a court judgment first. We recommend replacing it with a factual statement of the steps the company may take next.

Templates 4 and 5. The interest rate stated has no basis in the consumer terms. Until the terms are reviewed, the letters should claim statutory interest only, with the start date stated.

The situation

The company’s consumer collection letter templates, uploaded

Your company sells subscription software and hardware to consumers in the Netherlands and Poland and collects unpaid invoices in-house. The collection team uses five letter templates per country, written years ago, which add a flat fee, interest and a warning about a court case. A consumer organisation in Utrecht has just published a complaint about one of them.

Each letter is short. The hours go on the rules behind each sentence: whether collection costs may be charged at all and how much, when the first reminder must go out, what interest can run, and which threats cross into an unfair or aggressive practice. The answer differs per country and per letter.
